Rather than attempt to recreate the points and discussion over here, let me point you to Russell Sadler's recent BlueOregon column on the continuing debate over Measure 37, Oregon's land-use compensation initiative that was recently overturned in Marion County. Sadler's primary motive is to call attention to the rather amateurish recall effort, aided by the state's Constitution Party (think Judge Roy Moore), but the copious commentary broadens to an evaluation of both Judge James' ruling, and the common-man principles on which both M37 and the ruling are grounded.
Yours truly is one of those commenters, and so I'll point you in that direction for my thoughts on the matter within the context of other viewpoints.
